Article 1: General provisions

The e-commerce website of Hendrik De Bruyne under the trade name "Muziekhandel Oudenaarde," a sole proprietorship with its registered office at Moortelputstraat 28, 9031 Drongen, VAT BE 0740877090, RPR Ghent, hereinafter referred to as 'MHO,' offers its customers the opportunity to purchase products from its online store.These General Terms and Conditions ("Terms") apply to every order placed by a visitor to this e-commerce website ("Customer"). When placing an order through the MHO web store, the Customer must expressly accept these Terms, thereby agreeing to their applicability, excluding all other conditions. Additional terms of the Customer are excluded unless explicitly accepted in writing by MHO in advance.

Article 2: Price

All prices are expressed in EURO, always including VAT and any other taxes or charges borne by the Customer. If delivery, reservation, or administrative costs are charged, this will be separately stated.Sales ConditionsThe price statement refers exclusively to the items as described in words. The accompanying photos are decorative and may contain elements not included in the price.

Article 3: Offer

Despite the careful compilation of the online catalog and the e-commerce website, it is possible that the offered information is incomplete, contains material errors, or is not up-to-date. Obvious mistakes or errors in the offer do not bind MHO. MHO's liability regarding the accuracy and completeness of the offered information is limited. MHO is not liable in case of manifest material errors, typesetting, or printing errors.If the Customer has specific questions about, for example, sizes, color, availability, delivery time, or delivery method, we request the Customer to contact our customer service in advance.The offer is valid as long as stocks last and can be adjusted or withdrawn by MHO at any time. MHO cannot be held liable for the unavailability of a product. If an offer has a limited validity period or is subject to conditions, this will be explicitly mentioned in the offer.

Article 4: Online purchases

You can search for one or more products and place them in the shopping cart. From the shopping cart, you can check if the products you want to order are correct and confirm, leading you to the payment procedure.After payment, your order will be prepared in our warehouse and either shipped or ready for pick-up in our store. This depends on the choice you make during the ordering process.The Customer has the choice between the following payment methods:

MHO is entitled to refuse an order due to a serious failure of the Customer regarding orders in which the Customer is involved.

Article 5: Delivery and execution of the agreement Sales Conditions

Delivery times depend on our stock and the stock of our suppliers, and MHO cannot be held responsible for delays beyond the will or responsibility of MHO.Items ordered through this web store are delivered worldwide (excluding conflict areas) and except for items intended for EMEA (Europe, Middle East & Africa) only.Delivery is carried out by mail, freight transport, own transport, or other parcel carriers adapted to the place of delivery.Unless otherwise agreed or expressly stated otherwise, the goods are delivered to the Customer's place of residence within 30 days after receiving the order.Any visible damage and/or qualitative deficiency of an item or other shortcomings in the delivery must be reported immediately to MHO by the Customer.The risk of loss or damage passes to the Customer once they (or a third party designated by them, who is not the carrier) physically receive the goods. However, the risk already passes to the Customer upon delivery to the carrier if the carrier of the Customer has been instructed to transport the goods, and this choice was not offered by MHO.

Article 6: Retention of ownership

The delivered items remain the exclusive property of MHO until full payment by the Customer.The Customer undertakes, if necessary, to draw the attention of third parties to MHO's retention of ownership, e.g., to anyone who might seize the not yet fully paid items.

Article 7: Right of withdrawal

The provisions of this article apply only to Customers who, in their capacity as consumers, purchase items online from MHO.The Customer has the right to withdraw from the agreement within a period of 14 calendar days without giving any reason.The withdrawal period expires 14 calendar days after the day on which the Customer or a third party designated by the Customer, who is not the carrier, physically takes possession of the goods.To exercise the right of withdrawal, the Customer must inform Muziekhandel Oudenaarde, Beverestraat 32, 9700 Oudenaarde, 055/613913, through an unambiguous declaration, in writing by post, of their decision to withdraw from the agreement. The Customer can use the attached withdrawal form for this purpose, but is not obliged to do so.To comply with the withdrawal period, the Customer must send their communication regarding the exercise of the right of withdrawal before the withdrawal period has expired.The Customer must return or hand over the goods to MHO, Beverestraat 32, 9700 Oudenaarde, immediately, but in any case no later than 14 calendar days after the day on which they informed MHO of their decision to withdraw from the agreement. The Customer is on time if they return the goods before the 14-day period has expired.The direct costs of returning the goods are borne by the Customer.The Customer is requested to return the items in their original condition and packaging, with all accompanying accessories and instructions. If the returned product has diminished in value in any way, MHO reserves the right to hold the Customer liable and claim compensation for any reduction in the value of the goods resulting from the use of the goods by the Customer beyond what is necessary to establish the nature, characteristics, and functioning of the goods.All returned items are carefully examined. The starting point is that the consumer may only inspect the article as he would be allowed to do in a store. Returned items must not be used.If an item has undergone a decrease in value due to the use by the Customer, this will be charged to the Customer.If the Customer has requested the commencement of services during the withdrawal period, the Customer shall pay an amount proportionate to what has been delivered up to the moment he informs us of the withdrawal, compared to the full performance of the agreement.If the Customer withdraws from the agreement, MHO will refund all payments received from the Customer, including standard delivery costs, to the Customer within a maximum of 14 calendar days after MHO has been informed of the Customer's decision to withdraw from the agreement. In sales agreements, MHO may wait with the refund until it has received all goods back or until the Customer has demonstrated that he has returned the goods, whichever comes first.Any additional costs resulting from the Customer's choice of a delivery method other than the cheapest standard delivery offered by MHO will not be refunded.MHO will refund the Customer using the same means of payment with which the Customer made the original transaction, unless the Customer has expressly agreed otherwise; in any case, the Customer will not be charged for such reimbursement.The Customer cannot exercise the right of withdrawal for:service agreements after the full performance of the service or if the performance has begun with the express prior consent
